Three family leave changes start on 18 September 2026. They are for male workers whose spouse is pregnant, gives birth, or loses a pregnancy.
1. Parental leave before the birth
Until now, a male worker could take parental leave (yuga hyujik, 육아휴직) only after the child was born. From 18 September, he can take it during his spouse's pregnancy if there is a health risk, such as a risk of miscarriage or early birth. Apply at least 7 days before the leave starts.
2. Childbirth leave can start before the birth
Spouse childbirth leave is 20 paid days. Until now it could be used only within 120 days after the birth. From 18 September, it can be used from 50 days before the due date until 120 days after the birth. You can split it into up to 3 parts. Tell your employer in writing, with the due date and the days you want.
3. New leave after a miscarriage or stillbirth
If a male worker's spouse has a miscarriage or stillbirth, he can take up to 5 days of leave. The first 3 days are paid. Ask for it within 20 days of the loss.

An employer can no longer refuse shorter childcare working hours only because they cannot find a replacement worker.
About the government payment
The government payment for leave 2 and 3 goes only to workers at companies in the "priority support" group (useon jiwon daesang gieop, 우선지원대상기업). Ask your employer if yours is one.
